The purchase of ,,Laboratory equipment within the TERȚI 855/2026 research project”, according to the specifications in the tender specifications. Number of days before the deadline for submission of tenders/applications by which clarifications may be requested: 20 days. The contracting authority will respond clearly and completely to all requests for clarification: on the 11th day before the deadline established in the contract notice for the submission of tenders. The completion of the award procedure by concluding the public procurement contract is subject to the following condition precedent, which will apply for a maximum period of 3 months from the tender submission deadline: The conclusion of the public procurement contract is conditional upon the continuation of funding under the TERȚI 855/2026 research project, with the contract being signed only if the provisions concerning the commitment of expenditure from budgets subject to public finance legislation are complied with, and in compliance with the provisions of Decision No. 395/2016 approving the Methodological Norms for the application of the provisions concerning the award of the public procurement contract/framework agreement under Law No. 98/2016 on public procurement, as subsequently amended and supplemented. If, regardless of the reasons, funding under the TERȚI 855/2026 research project is not continued, the contracting authority will apply the provisions of Art. 212 para. (1) point c), second sentence, of Law No. 98/2016, as subsequently amended and supplemented, and it will be impossible to conclude the public procurement contract. Tenderers in this procedure understand that the Contracting Authority and/or MEC cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority and/or MEC were notified of the existence of such damage. Tenderers in this procedure accept the use of the above special conditions/condition precedent, assuming full liability in relation to any damage they might suffer in the situation described.
