The subject matter of contracts awarded under the established dynamic purchasing system (DPS) will be the purchase of desktop and server licences (goods, service/subscription), such as operating systems, client access licences (CAL), cloud software licences, office software systems for document creation and their extensions for mutual communication and collaboration. The objective of establishing the DPS is to create a platform for the state and public administration to award contracts under the DPS in order to enable contracting authorities and contracting entities to award contracts flexibly in accordance with the Public Procurement Act according to their actual needs, i.e. at a time and to an extent known to them, while also enabling the state's licence administrator to centrally manage and monitor the purchase of licences by individual controlled entities. The subject matter of partial contract No. 79 for ÚVZ SR was the supply of Microsoft products and services for the existing equipment in the following scope: • Win Server Datcr Core 16 SL Datacenter (AAA-90052) - 2 licences • Win Server User CAL (AAA-03786) – 300 licences The contracting authority also permits the supply of licences from the secondary market in accordance with Directive 2009/24/EC of the European Parliament and of the Council of 23 April 2009 on the legal protection of computer programs and the judgment of the Court of Justice of the European Union dated 03. 07. 2012. In the case of licences from the secondary market, the following licence versions are required: Win Server Datcr Core 16 SL Datacenter in the 2025 version, totalling 2 licences, and Win Server User CAL in the 2025 version, totalling 300 licences. Earlier licence versions, e.g. 2022, are not permitted. If the term “equivalent” is stated in the description of the subject matter of the contract, or if the description of the subject matter of the contract contains a reference or link to a specific manufacturer, manufacturing process, trade name, patent, type, area or place of origin or manufacture, the Central Purchasing Organisation permits tenderers to offer an equivalent to the required subject matter of the contract; in such a case, a (functional) equivalent is considered to be a solution/device that meets the utility, operational and functional characteristics necessary to ensure the purpose for which the procured subject matter of the contract is intended. Tenderers are not permitted to submit an alternative solution in relation to the required subject matter of the contract. If the tender also includes an alternative solution, the alternative solution will not be included in the evaluation of tenders and will be regarded as if it had not been submitted. Equivalents are not considered alternative solutions. The subject matter of the contract must be delivered within 5 days of receipt of the binding order for the purchase of licences or the entry into force of the concluded licence agreement constituting the subject matter of the contract in the required scope. Procedure: restricted. Estimated value: 187,461,181.04 EUR. Review the original TED notice for the complete requirement, lots, amendments and attachments.
